The City is acutely aware of the proliferation of illegal dumping across Tshwane. This situation has been exacerbated by the outright failure of the Administrators to manage and provide for adequate waste removal during their unlawful tenure.

Last year, the City identified more than 600 illegal dumping sites. This has evidently increased as residents dumped household and garden waste on open fields, roadways and outside municipal facilities.

The DA-led administration is committed to ensuring that the City is stable, safe and that it delivers. Eradicating illegal dumping is therefore a key executive priority.

To this end I had engagements with the Chief of Police, the Deputy Chief of Police responsible for Specialised Policing, and with the TMPD’s By-Law Enforcement Unit regarding enforcement of the City’s Waste Management By-Law. I also spoke to the MMC for Environmental and Agricultural Management and the Group Head of the Department about the liaison and interface between the TMPD and the Waste Management Division.

The following key actions have been instituted:
• The Chief of Police has issued a directive to instruct all uniformed TMPD officers in every Region to proactively enforce the By-Law and to apprehend suspects when they see them.
• The TMPD will provide my office with weekly statistics on the number of illegal dumping cases reported, the number of incidents they responded to, and the number of incidents proactively identified and addressed.
• The TMPD will also inform the Waste Management Division in the Department of Environmental and Agricultural Management of reported illegal dumping incidents for these to be cleared.

Members of the public are therefore encouraged to report incidents of illegal dumping when they encounter them to the TMPD at the 24-hour contact line on 012 358 7095 / 012 358 7096, or via email at tmpdcomplaints@tshwane.gov.za.

Residents and business are further reminded that illegal dumping is a criminal offence in terms of sections 24 the City of Tshwane Waste Management By-law of 2016. The disposal of any waste or waste material at any place or on any premises other than through waste collection or at municipal waste disposal sites is prohibited.

Any person found guilty of illegal dumping is liable to a maximum period of imprisonment of three years or a R60 000 fine, or both, as determined by a court. The City may further recover remedial and administrative costs as applicable and may also recover the costs of cleaning up the illegally disposed waste from the offender.

Residents are urged to join the City in taking a zero tolerance approach to illegal dumping by observing the by-law, reporting illegal dumping, and partnering with law enforcement to ensure a stable and safe Tshwane that delivers for all its residents.

Die Stad is terdeë bewus van die wyd verspreide onwettige storting van vullis regoor Tshwane. Hierdie situasie is booonop vererger deur die regstreekse versuim van die administrateurs om voldoende afvalverwydering te bestuur en daarvoor voorsiening te maak tydens hul onwettige ampstermyn.

Verlede jaar het die Stad meer as 600 onwettige stortingsterreine geïdentifiseer. Dit het klaarblyklik toegeneem namate inwoners huishoudelike en tuinvullis op oop velde, paaie en buite munisipale fassiliteite gestort het.

Die administrasie onder leiding van die DA is daartoe verbind om te verseker dat die stad stabiel en veilig is en dat dienste gelewer word. Die uitwissing van onwettige storting is dus ‘n sleutelprioriteit.

Vir hierdie doel het ek samesprekings gehad met die Hoof van die Tshwane Metro Polisie, die adjunkhoof van TMPD verantwoordelik vir gespesialiseerde polisiëring, en met die TMPD (Tshwane Metro Polisie Departement) se bywetstoepassingseenheid rakende die handhawing van die stad se verordening op afvalbestuur. Ek het ook met die LBK vir omgewings- en landboubestuur en die groepshoof van die departement gesels oor die skakel en interaksie tussen die TMPD en die Afvalbestuursafdeling.

Die volgende belangrike aksies is ingestel:

• Die polisiehoof het ‘n opdrag uitgereik om alle uniformdraende TMPD-beamptes in elke streek opdrag te gee om die verordening proaktief toe te pas en om verdagtes vas te trek as hulle oortreders sien.
• Die TMPD sal op ‘n weeklikse basis statistieke aan my kantoor verskaf oor die aantal onwettige stortingsgevalle wat aangemeld is, die aantal voorvalle waarop hulle gereageer het en die aantal voorvalle wat proaktief geïdentifiseer en aangespreek is.
• Die TMPD sal ook die Afvalbestuurafdeling in die Departement van Omgewings- en Landboubestuur in kennis stel van aangemelde onwettige stortingsvoorvalle om dit te verwyder.

Lede van die publiek word daarom aangemoedig om voorvalle van onwettige storting, wanneer hulle dit teëkom, by die TMPD aan te meld by die 24-uur-nommer op 012 358 7095/012 358 7096. Alternatiewelik kan skriftelike klagtes per e-pos gestuur word na tmpdcomplaints@tshwane.gov.za

Inwoners en sakeondernemings word verder daaraan herinner dat onwettige storting ‘n kriminele oortreding is in terme van artikel 24 van die verordening op die afvalbestuur van die stad Tshwane van 2016. Die wegdoen van enige afval of afvalmateriaal op enige plek of op enige perseel behalwe deur middel van die stad se afvalverwydering stelsel of by munisipale afvalstortingsterreine is verbode.

Enige persoon wat skuldig bevind word aan onwettige storting, is onderhewig aan ‘n maksimum tydperk van gevangenisstraf van drie jaar of ‘n boete van R60 000, of albei, soos deur die hof bepaal.
Die Stad kan verder regstellende en administratiewe koste, soos van toepassing, verhaal, en kan ook die koste verbonde aan die skoonmaak van die onwettig gestorte afval van die oortreder verhaal.

Inwoners word versoek om saam met die Stad ‘n zero verdraagsaamheid houding in te neem ten opsigte van die onwettige storting van afval deur die verordening te gehoorsaam, onwettige storting aan te meld en ‘n vennootskap met wetstoepassing aan te gaan om ‘n stabiele en veilige Tshwane te verseker wat vir al sy inwoners dienste lewer.
